Does that information include business plans, venting about an interaction, travel plans, or even competitive research?A vast and expanding trove of personal data is steadily being fed into AI chatbots that can be used to weave a clear picture of what you're planning to do next. Prosecutors unsealed arson and murder charges for the Palisades Fire on January 1, 2025, where twelve people died and thousands of homes were destroyed. Law enforcement used the suspect’s ChatGPT logs to build the case.I believe that case sends a clear signal that intent is now traceable through chatbot records. Your interactions with AI are as sensitive as your personal diary — times 10.DNA residue, fingerprints, everything you watch in crime shows pales in comparison to the private data that you have on your phone. Consider the added nuance and context that could be added to the data paired with records of real-time AI chatbot conversations. ChatGPT and similar tools capture mindset, motive, and thoughts in progress better than any digital artifact we’ve had access to in history. ChatGPT has become a confessional, a planning board, and a mirror for intent. During the 911 call, he reportedly asked ChatGPT, “Are you at fault if a fire starts from your cigarette?”These interactions are being used by investigators to trace a narrative of the accused plan to carry out the crime. In the hands of an adversary, what could your organization’s AI chat records reveal about the business’s future plans? Beyond trade secrets, every company where these LLMs are being regularly used are potentially generating new evidence every single day that could be used against it by law enforcement later. Several AI companies have already indicated their ability to flag user activity that appears to foreshadow a crime, including OpenAI: “In limited circumstances, OpenAI US and OpenAI Ireland may disclose user data to law enforcement agencies where it believes that making such a disclosure is necessary to prevent an emergency involving danger of death or serious physical injury to a person.”AI companies including OpenAI and Anthropic are getting much better at detecting foreign adversaries using these systems for malicious ends, and I can only imagine that they’re doing similar for people in the U.S. that may be looking to kill or commit acts of terror.Related:China's Flax Typhoon Turns Geo-Mapping Server into a BackdoorThese companies aren’t doing press releases to announce they are engaged in proactive reporting to law enforcement. Rather, they prefer to spotlight efforts to disrupt state-affiliated threat actors in Russia, Iran, and China, which is much easier to get a pat on the back for.Getting to ‘Yes’ on AI … Securely Now we need to talk about AI security.Fellow security peers, here’s what I’m seeing: Governance often becomes a system for denial and enables the “Security Framework of No.” I believe any business needs security to evolve into a structure that enables safe experimentation and learning. We’re running out of reasons to say “no.” Even highly regulated industries including banking, finance, and healthcare are already learning to say “yes.” They are testing, supervising, and building muscle for decentralized security.I can’t see another way for a company to stay competitive and manage the shadow AI issue, unless the default answer to AI usage in the company is "yes, unless the activity involves PII or restricted data." The motivation toward these workarounds isn’t reckless disregard for security; they are trying to meet demand.Saying no rarely works anyway. AI is embedded across every platform. Blocking tools built into Chrome, Bing, or iPhone apps only hides activity still occurring.When kids become teenagers, taking every device away fails. The better approach is teaching awareness of what’s safe, what’s risky, and what consequences look like. Governance should operate the same way, building awareness instead of enforcing control. Bans create false confidence. Block OneDrive links, and people email attachments. The data continues to move. Visibility disappears, and unseen risk grows.How do we achieve this? If I had the perfect answer, I’d already be selling it.One idea — security culture leans toward centralization, but AI already operates everywhere. What could distributed oversight look like? Decentralized security across each business unit. A security presence that observes, guides, and educates. Someone who can say, “Hey, that too is uploading client data. Here’s why.”For security to remain relevant and keep the business competitive, the baseline must shift from “no” to “yes, with guardrails.” No one fully understands AI yet. Admitting that truth is where leadership starts.As I write this, I’m remembering the movie Footloose. Rebellion grows when control tightens. The goal is not to stop the dance. It’s to ensure it happens safely.I wrote the SANS Institute Secure AI Blueprint to address governance risk in AI adoption. It focuses on three pillars: Protect, Utilize, and Govern AI.
